MASONIC MASTERWORKS USER AGREEMENT & AGE VERIFICATION TERMS

By clicking “I am 21 or older,” “Enter,” “Agree,” or otherwise accessing, browsing, or using the website located at www.masonicmasterworks.com (the “Site”), including any related pages, content, products, or services offered by Starr Studios Inc. d/b/a Masonic Masterworks (“Company,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be legally bound by this User Agreement and Age Verification Terms (the “Agreement”).
If you do not agree to these terms, or if you are under 21 years of age, you must immediately leave the Site.
### 1. Age Verification and Eligibility
You represent and warrant that:
- You are at least twenty-one (21) years of age.
- You are of legal age to view and purchase content and services related to firearms in your jurisdiction.
- You are not a prohibited person under the Gun Control Act of 1968 (as amended), the National Firearms Act, or any other federal, state, or local law (including but not limited to 18 U.S.C. § 922).
- You are legally permitted to possess, receive, and/or own firearms under the laws of the United States and the state in which you reside.
The age verification popup is a material condition of access. By verifying your age, you expressly agree to this entire Agreement. Providing false age information is a material breach and may result in immediate termination of access and potential legal consequences.
### 2. Nature of the Site and Services
The Site showcases and offers:
- Traditional hand engraving services on firearms (primarily Masonic-themed and custom original designs), performed exclusively by hand by Sean Starr using traditional tools (Lindsay AirGraver/chisel methods). No lasers, CNC, or computer-generated engraving is used.
- Original Masonic-themed artwork, restorations, and related commissions for lodges and private clients.
- Physical products such as customizable pewter Masonic coins, limited-edition prints, and other gifts.
- Portfolio images and descriptions of engraved firearms and related work.
Important: The Site is operated by Starr Studios Inc., a Federal Firearms Licensee (FFL Type 01 – Dealer/Gunsmith), License No. 5-74-395-01-7K-12171, located at 512 S Main Street, Calvert, Texas 77837. Engraving services constitute gunsmithing under federal law. We do not sell firearms through this Site unless explicitly stated otherwise. Engraving is performed on customer-supplied firearms only.
### 3. Firearm Engraving Services – Special Terms
If you request engraving services:
- You must contact us directly for a written proposal. A non-refundable 50% deposit is required to reserve a place on the waitlist and begin design work. Balance is due upon completion (photos of finished work are provided before final payment).
- All firearms must be shipped to us via FFL by FedEx or UPS, fully insured, with signature required (Return Receipt). You are solely responsible for all shipping costs, insurance, and compliance with carrier and legal requirements for shipping firearms.
- We will only receive and return firearms in accordance with federal and state law and our FFL privileges. We reserve the right to refuse any firearm or project.
- You represent that the firearm is legally owned by you (or the entity you represent), is not stolen, and that all requested engraving will not violate any law, including prohibitions on altering or removing manufacturer’s markings, serial numbers, or other required markings (see ATF regulations).
- Designs are original, one-of-a-kind creations. We do not copy other engravers’ work.
- Completion times typically range from one to two months but vary based on workload and complexity. No fixed deadlines are guaranteed.
- Payments may be made by credit card, bank transfer (preferred), or cryptocurrency as arranged.
### 4. Compliance with Laws
You agree to comply fully with all applicable federal, state, and local laws, including but not limited to:
- The Gun Control Act, National Firearms Act, and all ATF regulations.
- State and local firearm ownership, transfer, and possession laws in your jurisdiction.
- Export control laws (ITAR, EAR) if applicable.
- Any laws governing the display or purchase of firearm-related content or products.
You will not use the Site or our services for any illegal purpose, including but not limited to requesting engraving that would facilitate illegal activity, straw purchases, or prohibited modifications.
### 5. Purchases of Products (Coins, Prints, Gifts, etc.)
- Product descriptions, pricing, and availability are subject to change.
- Free shipping is generally offered to addresses in the continental United States on qualifying items. International shipping is available by special arrangement.
- Made-to-order items (e.g., custom coins) typically require 1–2 weeks.
- All sales are final unless otherwise stated in writing. Defective or damaged items must be reported within 7 days of receipt with photographic evidence.
- Title and risk of loss pass to you upon shipment.
### 6. Intellectual Property
All content on the Site — including designs, photographs, text, logos, artwork, and engraved patterns — is the exclusive property of Starr Studios Inc. / Sean Starr or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, create derivative works from, or commercially exploit any content without our prior written consent. Custom engraving designs created for you remain our intellectual property except for the physical application to your firearm; we retain the right to photograph and display completed work for portfolio and marketing purposes.
### 7. User Conduct and Prohibited Uses
You agree not to:
- Access the Site if under 21 or if you are a prohibited person under firearms law.
- Misrepresent your identity, age, or legal eligibility.
- Attempt to reverse-engineer, scrape, or harvest data from the Site.
- Upload or transmit any malicious code, spam, or unlawful content.
- Use the Site in any manner that could damage, disable, or impair our systems or reputation.
### 8. Disclaimer of Warranties
THE SITE, ALL CONTENT, AND ALL SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Engraving is a handmade craft; while we strive for excellence, variations inherent in traditional hand work may occur.
### 9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARR STUDIOS INC., SEAN STARR, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT OR YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $100 IF NO PAYMENT WAS MADE).
Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the fullest extent permitted by law.
### 10. Indemnification
You agree to indemnify, defend, and hold harmless Starr Studios Inc., Sean Starr, and their affiliates, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your breach of this Agreement.
- Your violation of any law or the rights of a third party.
- Your use of the Site or our services (including any firearm submitted for engraving).
- Any false representation regarding your age or legal eligibility to possess firearms.
### 11. Privacy
Your use of the Site is also governed by our Privacy Policy (if published) or applicable privacy practices. By using the Site you consent to the collection and use of information as described therein. For engraving projects, we collect only the information necessary to perform the work and comply with FFL record-keeping requirements.
### 12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of this Agreement. Provisions that by their nature should survive (including age representations, indemnification, limitation of liability, and intellectual property) shall survive termination.
### 13. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to this Agreement or the Site shall be resolved exclusively in the state or federal courts located in Robertson County, Texas (or the nearest appropriate venue). You consent to personal jurisdiction in those courts.
### 14. Changes to This Agreement
We reserve the right to modify this Agreement at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised terms. The version date at the top of this document indicates the most recent update.
### 15. Severability and Entire Agreement
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement, together with any written proposal or invoice for specific services, constitutes the entire agreement between you and us regarding the subject matter hereof and supersedes all prior or contemporaneous communications.
